The high court in Mombasa has ordered for the release of Mombasa CEC ,Mohammed Hussein on a bond of Kshs. 1 million with one contact person with an alternative of Kshs 500,000 cash bail with two contact persons.
Mohammed is being investigated by detectives of claims of ,cyber harrashment.High court judge Wendy Micheni further ordered police to carry their investigations within a period of six months.
The court further directed that,police investigating the matter should not harass Mohammed until investigations are concluded and that the entities investigating the matter should each play their roles unhindered.”I hereby order for through investigations and once they represent the report they should conduct their case and if they get a positive verdict then we can all say justice can has been found,”she stated she further observed that the case had been highly published however not based on certain concrete evidence.”
This is like a house built on a weak sand which cannot stand the test of time and constitutional scrutiny and cross examination all players must play by the book and if one side breaks the chain then the case collapses and the court is often left to blame ,”she stated.
The judge further pointed out that the Attorney General , Emmanuel Makuto representing the inspector General of police ,Douglas Kanja ,and the Director Directorate of criminal investigations ( DCI) Mohhamed Amin did not oppose the application for release on bond,his only concern was that what should happen if the Investigators would finalize the investigations and decide to charge the applicant ( Mohammed)”He prayed that the court issues a bond to the applicant to attend court,so that the investigations and the arraignment are not curtailed by this unrelated application for Anticipatory bond,”she ruled.
Similarly Justice Wendani ruled that the law society of Kenya which has been enjoined as an interested party in the matter did not oppose Mohammed release on Bond.
