The state has withdrawn a defamation matter, against the personal secretary to Mombasa business man,Mohammed Jaffar ,Matilda Kinzani.
Mombasa senior resident magistrate,David Odhiambo in his ruling stated that ,the state had admitted that the charges preferred against Kinzani were shaky and that the office of the director of public prosecutions ,Renson Ingonga made an application before the court to have the charges terminated.
“In the circumstances I hereby order the charges to be terminated ,the cash bail to be refunded to the deposited following the ODPPS application, additionally the respondent shall not be arrested on the same charges,”stated Odhiambo.
Odhiambo indicated that it was the decision of the state ,through the office of the director of public prosecutions ( ODPP)that had sought to terminate the charges against the accused person under section 25 (1) of the office of public prosecutions Act.
An act that the trial magistrate stated ,that the ODPP,may with the permission of the court,discontinue a prosecution commenced by the ODPP at any stage in the course of the trial stage ,before delivery of the judgement.
Kinzani, was been charged in connection to cyber crime offences ,after she was alleged to have authored and circulated a letter ,alleging that Ali Hassan joho ,and his elder brother Abubakar Joho,popularly known as (Abu )had embezzled money at the Mombasa county government ,and that Abu was behind the stealing of containers at the port of Mombasa.
Further, it was alleged that the accused claimed that the businessman was a drug dealer.
