The father of a 25-year-old man accused of malicious damage to property appeared in court yesterday requesting his son to be jailed due to his addiction.

Joakim Ogutu argued that it was a necessary lesson to his son namely Milton Otieno rather than a tragedy that was awaiting him.

Ogutu expressed fear of his life noting that his son’s actions deserved punishment.

He told the court that the son’s regular death threats and physical assaults had forced him to flee his house to live with a neighbor.

Otieno who appeared before Mombasa residents magistrate Green Odera is accused of damaging flasks and glasses belonging to his father.

The particulars were that on the 28th day of April this year at Majengo area in Mvita within Mombasa sub-county, Otieno wilfully and unlawfully damaged household utensils namely flasks and glasses the property of Joakim Ogutu.

Otieno faced an additional charge of offensive conduct likely to cause a breach of peace contrary to section 94(I) of the penal code.

The court heard that Otieno used abusive words to his father by saying to him ”Malaya, Mshenzi, nitakufira ng’ombe” which was in a manner likely to cause a breach of peace.

Otieno however pleaded not guilty to all his charges.

The matter is coming up on 28/05/2026 for pre-trial and directions.
