Court issues last adjournment in,a civil suit pitting Mombasa maize millers and Grain bulk Handlers Ltd.
The high court in Mombasa has issued a last adjournment in a matter where a company associated with Mombasa businessman Mohammed Jaffar has been sued, by Mombasa maize millers for breaching a contract worthy over kshs.90 million.
High Court judge Florence Macharia questioned Mombasa maize millers on why they were yet to file,their assessment report to allow the matter proceed for hearing since the year 2020.
She issued the last adjournment.
Justice Macharia stated that her court would not keep on mentioning the matter considering that the judiciary was following guidelines on case management.
“This is the last mention. Why are you yet to file your assessment report while all along you have sought for more than two adjournments,” She posed.
The lawyer for Mombasa maize millers had sought for more time to file the assessment ,report before the court.
The lawyer requested for 45 more days to file all the relevant documents.
On his part, Grain bulk handlers Ltd, now known as Bulk Stream through lawyer Michael Oloo, informed the court that they had already filed their documents and were ready to proceed with the hearing.
Grain bulk handlers Ltd has been sued for breach of contract by failing to supply grains to Mombasa maize millers worthy 90.8 million.
In the suit, Mombasa maize millers is listed as the plaintiff ,while Bulk stream l listed as the respondent.
The matter will be mentioned on July 20, 2025.
