The hearing of a case involving a disputed Sh14 million property in Ukunda, Kwale County, did not proceed on February 10, 2026, after the accused, Valerine Achieng Opondo, failed to appear in court.
The matter arises from a suit filed by Kenya–Germany resident Sibabu Ali Mwamjibu, who accuses Opondo of irregularly removing his name from the title deed of a 0.048-hectare parcel they allegedly acquired jointly in 2017. He claims that in August 2023, documents were processed at the Kwale County Land Registry resulting in the deletion of his name from the title without his consent.
Opondo has denied the allegations.During the session, Opondo’s advocate informed the court that she was unwell and therefore unable to attend. The court was told that the explanation had been communicated via email. However, no medical documents were presented to substantiate the illness claim, and the alleged email was not formally produced or authenticated in court.Counsel for the complainant noted the absence of supporting documentation.
The court observed that no proof of illness had been filed on record and directed that the matter be mentioned on a later date.The case is now scheduled for hearing on October 5, 2026.Mwamjibu is seeking orders including an independent valuation of the property and a determination of the parties’ respective interests in the disputed parcel.
